Can I switch letting agents if I already have a tenant in place?

Yes. You do not normally need to wait for the tenant to leave. The current management agreement must be reviewed and the outgoing agent given the correct notice. The tenancy can continue while the management responsibility changes.

Do I need to contact my current letting agent myself?

No. Once you have authorised Albany to act and the timing has been agreed, we can handle the communication with the outgoing agent, request the tenancy file and arrange the practical handover.

What should the outgoing agent hand over?

Scotland's Letting Agent Code of Practice requires written confirmation of the end date, fees and funds, and the arrangements and timescales for handing back keys, relevant certificates and other necessary documents. If tenants remain, the outgoing agent must tell them about the change and provide the relevant contact details. Albany also requests rent records, deposit information, inspections, maintenance history and open issues.

How long does switching letting agents take?

The timescale depends on the notice period in your management agreement, any disputed charges and how quickly the outgoing agent supplies the file. Albany gives you a realistic plan after reviewing your agreement rather than promising an arbitrary deadline.

Will switching disrupt my tenant?

It should not. Albany contacts the tenant, explains the change, confirms the maintenance route and provides any new rent payment instructions in writing. The aim is continuity, not confusion.

Will my tenant need a new tenancy agreement?

Usually not simply because the managing agent changes. The existing tenancy ordinarily continues. If any tenancy terms themselves need to change, that must be dealt with separately and properly recorded.

How much does it cost to switch to Albany?

Albany does not charge a separate switching fee. Our ongoing management fees and service are explained before you commit. Your outgoing agent may still charge a termination fee or other amount permitted by the current agreement, so we review those terms with you.

What happens to my tenant's deposit?

We identify the approved scheme, verify that the deposit remains protected, check the recorded landlord and tenancy details, and coordinate any update or transfer required by the scheme. The landlord remains responsible for meeting the Scottish deposit rules.

What happens to rent, arrears and money held by the old agent?

We agree a cut-off date, obtain the rent account and check any arrears or credits. The outgoing agent should account for funds held and settle the final balance in line with the agreement and the Letting Agent Code of Practice. The tenant receives clear payment instructions for the next rent due.

Can Albany take over if compliance work or repairs are outstanding?

Yes. We review the available safety records, landlord registration, deposit information and maintenance history. Missing or expired items are flagged, and we can coordinate the necessary work with your approval. The handover does not remove the landlord's legal responsibilities, but it does give the outstanding work a clearer owner and plan.

Albany cannot act for a landlord who refuses or unreasonably delays meeting their legal obligations.

What should I look for in a new Edinburgh letting agent?
